How do I find out if a house is in foreclosure or pre-foreclosure if it isn’t listed anywhere?

I am trying to find out if my ex has let our home go into foreclosure. I know he hasn’t paid the mortgage in 9 months, but somehow he still lives there.

Before a loan can be foreclosed, it must be declared “in default.” A “Notice of Default” is recorded in your county. That notice is part of the public records. The fastest way is to have a Realtor contact a Title company and ask if the Notice has been filed in the last year. From the day the NOD is filed there is usually 120 calendar days until the property is auctioned at the courthouse steps.

If there is no NOD, then it still isn’t officially in default.
